Fasal Care Warranty Terms

Wolkus Technology Solutions Private Limited (“Fasal”) operating under the brand name “Fasal” offers an extended Warranty exclusively for its Fasal 3.0 IoT Devices (hereinafter called “Fasal Care Warranty”). The Fasal Care Warranty applies exclusively only to Fasal branded hardware and sensor products forming part of the Fasal 3.0 IoT Devices that you have purchased from Wolkus Technology Solutions Pvt. Ltd. or from its authorised resellers or distributors for your own use and not for resale.

Warranty coverage

Fasal Care Warranty shall be valid for a period of twelve (12) months commencing from the date of expiry of the Fasal Limited Warranty (which is valid for 12 months from date of purchase of the device) (“Extended Warranty Period”). It is clarified that the Extended Warranty Period commences upon the date of expiry of 12 (Twelve) months from the date you purchased the Product (as recorded in the sales invoice). Please retain your sales invoice (in original) along with this warranty information card/document. Fasal warrants the Product against any manufacturing defects in the Product during the Extended Warranty Period. If the hardware or software component of the product becomes defective during the Extended Warranty Period, Fasal will, at its option and without charge, repair the Product with new or reconditioned components or parts, or replace the Product with a new or reconditioned Product of the same or functionally equivalent model. All shipping costs with respect to shipping the unit to Fasal's support facility will be the customer's responsibility and return shipping to the customer will be the responsibility of Fasal. Fasal's responsibility begins with receipt of the unit at Fasal's support facility

How is the repair/replacement handled?

If an incident or issue occurs, the customer should use the “Help” section in the Fasal app to raise a support ticket. Alternatively, they can contact their Fasal sales representative or Fasal team from the contact details available in the sales invoice. Once the issue is raised, a support ticket will be generated and the same will be emailed to the customer's registered email. No warranty claim or repair/replacement claim will be entertained without the support ticket generation. Fasal's representatives will ask a series of questions designed to determine the extent of the issue, damage or failure. Depending on the cause and extent of the issue or damage, Fasal will then initiate the appropriate repair service. Once your support number has been provided to you, the Fasal technician will then provide instructions for returning your Product to our support facility.

Limitations

To the extent permitted by law, this warranty and the remedies set forth are exclusive and in lieu of all other warranties, remedies and conditions, whether oral, written, statutory, express or implied. Fasal disclaims all statutory and implied warranties, including without limitation, warranties of merchantability and fitness for a particular purpose and warranties against hidden or latent defects, to the extent permitted by law. Insofar as such warranties cannot be disclaimed, Fasal limits the duration and remedies of such warranties to the duration of this express warranty. If the product is defective in materials or workmanship, your sole and exclusive remedy shall be repair or replacement as provided above. However, if the remedy fails for its essential purpose, Fasal reserves the right to refund the purchase price of the product to the Purchaser in exchange for the return of the product. Fasal, and its suppliers, shall not be liable for any damages including, but not limited to, direct, indirect, incidental or consequential damages, loss of use or data, loss of profits or interruption of business, whether such alleged damages are based in warranty, tort (including negligence and strict liability, but excluding personal injury), contract, or indemnity, except to the extent prohibited by law. This warranty does not cover damage caused by the use of any instrument not specifically designed for use with the product. The limitations set out herein are not to be deemed or construed as exhaustive and the warranty provisions set out in these warranty terms and conditions, as amended from time to time, shall prevail. Warranty Voidance

Notwithstanding anything to the contrary contained herein, you hereby expressly acknowledge and agree that the Fasal Care Warranty shall not apply in case of: (a) removal or alteration of labels on the product or its parts, (b) failure or damage resulting from misuse, accident, modification, tampering, unsuitable physical or operating environment, natural disasters, lightning strikes, acts of god, improper maintenance by you or any force majeure event and/or (c) any other action or omission by you in relation to usage of the product which leads to damage of the product. The warranty shall stand invalidated accordingly and you will have no right to make any claims or seek any damages, refund or replacement for the product in such event. Any and all disputes arising from warranty claims made under this, will be settled by courts at Bangalore, India.
